Promotion Terms & Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to residents of Australia aged 18 years or over only. Employees (and their immediate families) of the Promoter, participating retailers, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Errors and omissions may be accepted at the Promoter's discretion.
4. Prize 1 final closing date for entries is 11:59pm (AEDST) on 30th October 2009. Prize 2 final closing date for entries is 11:59pm (AEDST) on 30th November 2009.
5. To be eligible to enter, consumers must either;
· Purchase and collect 4 barcodes from any Bellata Gold or Yatta pasta range between Monday 1st October 2009 and 30th October 2009 to be eligible for Prize Draw 1. Purchase and collect 4 barcodes between 1st November 2009 and 3oth November 2009 to be eligible for Prize Draw 2.
· You are then required to post the 4 barcodes to the Bellata Gold Head Office, in addition to your contact details (name, address, phone, email).
· Orders of 4 boxes or more received via our online website www.bellatagold.com.au during the period of the competition will automatically be entered in the draw.
· One entry form will be randomly selected on 2nd November 2009 and 1st December 2009, the first correct entry received will be announced the winner.
6. The prize draws will take place at Bellata Gold Head Office, Tamworth NSW, 2397 at 11am (AEDST) on 2nd November 2009 and 11am (AEDST) on 1st December 2009. Winners, if any, will be notified by telephone and mail and their name(s) will be published on the promoters website www.bellatagold.com.au.
7. The first valid entry drawn on 2nd November 2009 will win the following trip for two (2) adults valued at approximately $3,500 depending on point of departure: Promotion1 includes; Return economy airfares between winner’s closest Australian state/territory capital city to Tamworth. Flight departs Sydney 15th January 2010 and returns 20th January 2010 Return airport transfers between Tamworth airport and accommodation Five (5) nights accommodation at Settlers Inn, 4.5* Hotel, Tamworth; Two (2) VIP Passes to sponsored Country Music Festival events, subject to availability; Guided tour of Bellata Gold Pasta Plant and Mill. 8. The first valid entry drawn on 1st December 2009 will win the following trip for two (2) adults valued at up to $3,500 depending on point of departure: Promotion 2 includes; Return economy airfares between winner’s closest Australian state/territory capital city to Tamworth. Flight departs Sydney 20th January 2010 and returns 24th January 2010 Return airport transfers between Tamworth airport and accommodation Four (4) nights accommodation at Settlers Inn, 4.5* Hotel, Tamworth; Two (2) VIP Passes to sponsored Country Music Festival events, subject to availability, Guided tour of Bellata Gold Pasta Plant and Mill. 9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements;
10. Entrants must retain their original purchase receipt(s) or a photocopy of their receipt(s) for all entries as proof of purchase, dated during the Competition Period but prior to entry to qualify to receive a prize. Failure to produce proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, deem all entries submitted by that entrant invalid and therefore ineligible to receive a prize.
11. Incomplete, indecipherable or illegible entries will be deemed invalid.
12. Total prize pool value is approximately AUD$3,500 for promotion 1 and AUD$3,500 for promotion 2 including GST.
13. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
14. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.
15. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize or an element of a prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
16. The Promoter’s decision is final and no correspondence will be entered into.
17. The Promoter and any of their employees, contractors and agents or employees of their contractors and agents, reserve the right to refuse to allow a winner or any/all companions to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a winner is not, in the Promoter's or contractors/agent's opinion, in a condition necessary to be able to take or participate in the prize. The winner and their companions may be required to sign a legal release and/or other documentation in a form determined by the Promoter in its absolute discretion.
18. It is a condition of accepting a prize that the winner agrees to be interviewed, photographed and filmed at any time during the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured by the Promoter (or any other form of media it deems suitable) without further remuneration or reference to the participant. The decision to include any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
19. The winner accepts their prize at their own risk. To the full extent permitted by law the Promoter, and any of their employees, contractors and agents or employees of their contractors and agents, and companies providing prizes for the Promotion, will not be held liable for any liability/loss/damage/expense/death/personal injury suffered or incurred or any damage/loss (including, but not limited to, direct/indirect/consequential loss) arising out of, or in connection with this Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) use of or participation in a prize; or (g) promotion of this competition.
20. The Promoter and its related bodies corporate make no warranties and accept no liability in relation to any prize, its condition or fitness for any purpose. All warranty claims should be directed to the manufacturer of the prize.
21. All entries become the property of the Promoter. The information from the entries is being collected by the Promoter to enable it to contact the potential winner and/or may be entered into a database. By entering the Promotion all entrants consent to the Promoter using the entrant’s personal details for an indefinite period (unless consent is later retracted) for future promotional, marketing, publicity, research or profiling purposes including sending electronic messages or telephoning the entrant unless otherwise advised by the entrant upon entry. All personal details of the entrants will be stored at the office of the Promoter and a request to access, update, correct or delete any information can be made by contacting the Promoter at their address set out below. You consent to the Promoter’s use and disclosure of information about you as contemplated by this condition.
22. Should a participant’s contact details change during the Competition Period, it is the participant’s responsibility to notify the Promoter.
